Please read these Terms of Use ("Terms") carefully before accessing or using the RoomView platform, website, or any related services (collectively, the "Service") operated by RoomView ("we," "us," or "our"). By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree to all of the Terms, you may not access or use the Service.
These Terms apply to all visitors, users, hotel partners, and others who access or use the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
If you are accessing the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.
RoomView is a room-level transparency and hotel intelligence platform designed to provide guests, hotels, and hospitality professionals with data-driven insights about individual hotel rooms, including view quality assessments, room scoring, pricing intelligence, and related analytics.
The Service includes, but is not limited to:
RoomView is currently operating in an early access phase. Features, availability, and functionality are subject to change. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that violates applicable federal, state, local, or international laws or regulations.
Acceptable Use. You are permitted to access and use the Service for its intended purposes: exploring room-level data, reviewing hotel intelligence, evaluating RoomView as a hotel partner, or developing authorized integrations with RoomView-issued credentials. Guest users may browse the platform and use room discovery tools for personal, non-commercial purposes at no charge.
Prohibited Conduct. You agree that you will not, under any circumstances:
We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any violation of these Terms.
The Service and its entire contents, features, and functionality — including but not limited to all text, graphics, logos, button icons, images, data compilations, software, scoring methodologies, and the selection and arrangement thereof — are owned by RoomView, its licensors, or its hotel partners and are protected by United States and international copyright, trademark, trade secret, and other intellectual property or proprietary rights laws.
The RoomView name, the RoomView logo, "See It Before You Book It," View Value, and all related product and service names, design marks, and slogans are trademarks or service marks of RoomView. You may not use any of these marks without our prior written permission.
RoomRank — Patent Pending. The RoomRank room quality scoring system, including the underlying methodology, algorithms, weighting factors, and data processing approach used to evaluate and rank individual hotel room views, is the subject of a pending patent application. Unauthorized use, reproduction, or commercial exploitation of the RoomRank system or its methodology is strictly prohibited and may subject violators to legal action.
Nothing in these Terms grants you any right, title, or interest in or to the Service or its intellectual property beyond the limited right to access and use the Service as expressly set forth herein. All rights not expressly granted are reserved.
If you provide us with feedback, suggestions, or ideas about the Service, you agree that we may use such input freely and without obligation or compensation to you.
Hotels, property management companies, and other hospitality entities that enter into a partnership agreement with RoomView ("Hotel Partners") are subject to these Terms in addition to any separately executed partnership, service, or data sharing agreements ("Partner Agreement"). In the event of a conflict between these Terms and a Partner Agreement, the Partner Agreement shall control with respect to the specific subject matter addressed therein.
By becoming a Hotel Partner, you represent and warrant that:
Hotel Partners retain ownership of their underlying property data as provided to RoomView. However, RoomView retains all rights to derived outputs, enriched datasets, RoomRank scores, and intelligence products generated by applying the RoomView platform to that data.
RoomView reserves the right to remove a hotel from the platform or suspend partner access at any time if the partner is found to be in violation of these Terms, the Partner Agreement, or any applicable law.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROOMVIEW EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
RoomView does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, reliability, or timeliness of any room data, RoomRank scores, pricing intelligence outputs, or other information made available through the Service.
Room view quality data, scores, and related assessments reflect conditions at the time of data collection and are subject to change due to construction, landscaping, environmental changes, or other factors outside our control. RoomView makes no guarantee that the information displayed represents current conditions at any property.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROOMVIEW, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
IN NO EVENT SHALL ROOMVIEW'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO ROOMVIEW IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
The limitations in this section apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if RoomView has been advised of the possibility of such damage. Some jurisdictions do not allow the limitation or exclusion of liability for certain types of damages, so some of these limitations may not apply to you.
You agree to defend, indemnify, and hold harmless RoomView and its officers, directors, employees, contractors, agents, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
RoomView reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You agree not to settle any such matter without the prior written consent of RoomView.
The Service may contain links to third-party websites, services, or resources that are not owned or controlled by RoomView. These may include hotel booking platforms, property management systems, distribution channels, and other hospitality technology providers.
RoomView has no control over, and assumes no responsibility for, the content, privacy policies, practices, or terms of any third-party websites or services. We do not warrant or make any representations about the accuracy, completeness, or reliability of any content found on third-party sites.
We strongly advise you to read the terms and privacy policies of any third-party websites or services you visit. The inclusion of any link to a third-party site does not imply our endorsement of, or affiliation with, that site or its operators. Your use of any third-party site is at your own risk.
RoomView reserves the right to modify, update, or replace these Terms at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page. For material changes, we may also provide additional notice, such as a banner on the Service or an email notification to registered users or Hotel Partners.
It is your responsibility to review these Terms periodically. Your continued access to or use of the Service after any changes to these Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue your use of the Service.
Changes to these Terms will not be applied retroactively and will not affect any disputes that arose prior to the effective date of the change.
These Terms and any dispute or claim arising out of or related to these Terms, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States and the State of Missouri, without giving effect to any choice of law or conflict of law rules or provisions.
Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in Missouri, and you hereby consent to the personal jurisdiction and venue of such courts. Nothing in this section shall limit RoomView's right to seek injunctive or other equitable relief in any court of competent jurisdiction.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. The failure of RoomView to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
